Welcome to Mainstream Home Improvement. By accessing our website at mainstreamhi.com, scheduling a consultation, requesting a quote, or engaging any of our services, you agree to be bound by the following Terms of Service. Please read these Terms carefully before using our services. If you do not agree to these Terms, please do not use our website or services.


1. Company Information

Mainstream Home Improvement is a licensed home improvement contractor serving the Quad Cities Metro Area and surrounding communities in Western Illinois and Eastern Iowa. Our services include window replacement, door installation, siding, roofing, gutter installation, gutter covers, and other residential and commercial home improvement projects.

2. Services Provided

Mainstream Home Improvement provides residential and commercial home improvement services. All services are subject to a written contract or proposal provided prior to commencement of any work. The specific scope of work, materials, labor, and pricing will be outlined in a separate written agreement signed by both parties.

We reserve the right to:

  • Decline any project or service request at our sole discretion.
  • Modify the scope of services if unforeseen conditions are discovered during a project.
  • Subcontract portions of work to licensed and insured subcontractors as necessary.

  • Residential Home Siding Installation & Replacement
  • Residential Home Roofing Installation & Replacement
  • Seamless Gutter Installation & Replacement
  • Gutter Cover Installation

3. Estimates, Quotes & Pricing

All estimates and quotes provided by Mainstream Home Improvement are valid for 1 year from the date of issue unless otherwise stated in writing. Prices are subject to change due to material cost fluctuations, labor market conditions, or changes in project scope.

Important Pricing Disclosures:

  • A signed contract or written authorization is required before any work begins.
  • Additional charges may apply if hidden damage, structural issues, or code violations are discovered after work commences.
  • Any change orders must be agreed upon in writing before additional work is performed.
  • Sales tax and permit fees may be additional and will be disclosed upfront.
  • Special promotional pricing is subject to expiration dates and applicable restrictions.

4. Payment Terms

Payment terms will be specified in your individual project contract. Generally, our payment structure may include a deposit upon contract signing, progress payments during installation, and a final payment upon project completion. Accepted payment methods include cash, check, credit card, and approved financing options.

Late Payments

Accounts past due beyond 30 days may be subject to a monthly service charge of 1.5% (18% annually) on the unpaid balance, or the maximum rate permitted by applicable state law, whichever is less. In the event of non-payment, Mainstream Home Improvement reserves the right to file a mechanic’s lien against the property as permitted by applicable law in Illinois or Iowa.


5. Cancellation & Right of Rescission

In accordance with applicable federal and state consumer protection laws (FTC Cooling-Off Rule), residential customers who sign a contract at their home or at a location other than our permanent place of business have the right to cancel the contract without penalty within THREE (3) BUSINESS DAYS of signing. This right of rescission will be clearly disclosed in your contract documents.

Cancellation After the Rescission Period

  • Before materials are ordered: A restocking or administrative fee may apply.
  • After materials have been ordered or custom-fabricated: Customer may be responsible for the full cost of materials, including custom window or door orders that cannot be returned.
  • After work has commenced: Customer is responsible for the value of work completed plus all materials purchased or ordered for the project.

6. Warranties

6.1 Workmanship Warranty

Mainstream Home Improvement warrants all labor and workmanship for a period of 5 years from the date of project completion. This warranty covers defects in installation and workmanship. It does not cover damage caused by misuse, abuse, neglect, acts of nature, building settlement or structural movement, or modifications made by others.

6.2 Manufacturer Warranties

Products and materials installed by Mainstream Home Improvement — including Infinity® by Marvin® windows and doors — carry their own manufacturer warranties. These warranties are passed through to the customer and are subject to each manufacturer’s terms and conditions. Mainstream Home Improvement will assist customers in filing warranty claims but is not responsible for fulfilling manufacturer warranty obligations.

6.3 Warranty Limitations

  • Warranties are non-transferable unless otherwise agreed in writing.
  • Warranty claims require written notice within the warranty period.
  • Warranty service will be scheduled within a reasonable time and does not entitle the customer to consequential or incidental damages.
  • Warranty is void if the installation area has been modified, repainted, or altered without our written authorization.

7. Licensing, Insurance & Permits

Mainstream Home Improvement holds all required state and local licenses to perform home improvement work in Illinois and Iowa. We carry general liability insurance and workers’ compensation insurance as required by law. Certificates of insurance are available upon request.

Permits

Where required by local building codes, Mainstream Home Improvement will obtain necessary permits on behalf of the customer. Permit fees will be passed through at cost and disclosed before work begins. The customer grants Mainstream Home Improvement authorization to apply for and obtain necessary permits for the agreed scope of work.

Customers are responsible for disclosing any known HOA restrictions, historic district requirements, or deed covenants that may affect permit approval or product selection prior to signing a contract.


8. Customer Responsibilities

To ensure a successful project, the customer agrees to:

  • Provide clear and safe access to the work area on scheduled service dates.
  • Remove personal items, furniture, valuables, and window treatments from the work area prior to installation.
  • Disclose known property conditions that may affect the work, including asbestos, lead paint, mold, or structural issues.
  • Ensure that a responsible adult (18 years or older) is present during all scheduled work.
  • Obtain any HOA or building management approvals prior to commencement of work, if applicable.
  • Secure pets during project dates to protect both the animal and our crew.
  • Keep all children away from the active work zone.

Failure to meet these responsibilities may result in project delays, additional charges, or rescheduling fees at Mainstream Home Improvement’s discretion.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAINSTREAM HOME IMPROVEMENT’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC PROJECT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL MAINSTREAM HOME IMPROVEMENT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF USE, LOSS OF PROFITS, OR PROPERTY DAMAGE BEYOND THE SCOPE OF THE PROJECT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits our liability for personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.


10. Dispute Resolution

10.1 Informal Resolution

We encourage customers to contact us directly to resolve any disputes or concerns before pursuing formal legal action. Most issues can be resolved quickly through open communication. Please contact us at (309) 762-6244 and allow 10 business days for our response.

10.2 Mediation & Arbitration

If informal resolution fails, the parties agree to participate in good-faith mediation before initiating litigation. Any disputes not resolved through mediation shall be settled by binding arbitration under the rules of the American Arbitration Association (AAA) in Rock Island County, Illinois, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

10.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.


11. Website Use & Intellectual Property

All content on mainstreamhi.com — including text, images, logos, graphics, and videos — is the property of Mainstream Home Improvement or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Prohibited uses of our website include:

  • Submitting false, misleading, or fraudulent information.
  • Transmitting spam, malware, or any harmful code.
  • Attempting to gain unauthorized access to our systems or servers.
  • Engaging in any activity that disrupts or interferes with the website’s functionality.
  • Scraping or harvesting data from our site without written permission.

12. Privacy Policy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and protect your personal information.

By using our services, you consent to the data practices described in our Privacy Policy. We do not sell your personal information to third parties. Information submitted through our website is used solely to respond to inquiries and provide the requested services.


13. Lead Generation & Communications Consent (TCPA)

By submitting a contact form, requesting a quote, or providing your phone number or email address through our website or during a consultation, you expressly consent to receive communications from Mainstream Home Improvement via phone calls (including automated or pre-recorded messages), text messages (SMS/MMS), and email regarding our products and services. Message and data rates may apply.

You may opt out of marketing communications at any time by:

  • Replying STOP to any text message.
  • Clicking the unsubscribe link in any marketing email.
  • Calling us at (309) 762-6244 to request removal from our contact list.

Opting out of marketing communications does not affect service-related communications about an active project.


14. Financing Disclosure

Mainstream Home Improvement may offer third-party financing options for qualifying customers. Financing is provided by independent lenders and is subject to their terms, conditions, and credit approval. Mainstream Home Improvement is not a lender and is not responsible for financing decisions, rates, or terms, which are determined solely by the financing provider.

Equal Credit Opportunity Act (ECOA) rights apply. Approval is subject to credit qualification. Advertised promotional financing (e.g., “12 months no interest, no payments”) is subject to restrictions and lender-specific terms. 15. Force Majeure

Mainstream Home Improvement shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, or extreme weather conditions
  • Labor strikes or material shortages
  • Supply chain disruptions
  • Pandemic-related restrictions or government orders
  • Fire, flood, or other casualty events

In such cases, we will notify you as soon as practicable and make reasonable efforts to resume performance. Project timelines affected by force majeure events will be rescheduled at mutual agreement without penalty to either party.


16. Modifications to These Terms

Mainstream Home Improvement reserves the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective upon posting to our website. The “Last Updated” date at the top of this page will reflect the most recent revision.

Your continued use of our website or services following any posted changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.


17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.


18. Entire Agreement

These Terms, together with any signed project contract, written proposal, and our Privacy Policy, constitute the entire agreement between you and Mainstream Home Improvement regarding your use of our services. These Terms supersede all prior or contemporaneous understandings, representations, or agreements — whether written or oral — relating to the subject matter herein.
